Jonathan Auerbach serves as Of Counsel at Radulescu LLP.  His practice focuses on patent litigation in federal district courts, the International Trade Commission, and before the Patent Trial and Appeal Board. He has participated in all aspects of litigation, including pre-suit investigations, handling offensive and defensive discovery, expert discovery, and trial. Jonathan has extensive experience in patent litigation for clients in the LED lighting, pharmaceutical, and financial services industries.

Represented Cephalon in multiple patent infringement cases in the District of Delaware involving its treatment for chronic lymphocytic leukemia and non-Hodgkin lymphoma, TREANDA®; patents found valid and infringed after two-week bench trial.

 

Seattle Children’s Hospital v. Teva Parenteral Medicines, Inc

Represented Teva in a patent infringement action under the Hatch-Waxman Act in the District of Delaware in response to Teva’s filing of an ANDA seeking approval to market a generic version of Novartis’s drug TOBI®.


Merck KGaA v. ImClone Systems

Represented Merck in an arbitration proceeding against ImClone for indemnification for breach of provisions in a patent license.

Koninklijke Philips N.V. v. Wangs Alliance Corp., d/b/a WAC Lighting

Counsel for defendant WAC Lighting in a patent infringement action filed by Philips (represented by Finnegan Henderson) in the District of Massachusetts involving 10 patents relating to LED technology including patents originating from Color Kinetics Inc.

 

Philips Lighting v. Wangs Alliance Corp., d/b/a WAC Lighting

Counsel for respondent WAC Lighting in an International Trade Commission Investigation brought by Philips involving five patents relating to LED technology.
